In an Accident While Using Uber or Lyft?

Millions of people across the United States use ridesharing services such as Uber and Lyft every day. As these numbers grow, and more drivers get out on the road, there’s one other statistic to look out for—accidents. As with many things in life, it’s a matter of “when” not “if,” but when the time comes and you’re involved in an accident while using an Uber or Lyft, what should you do?

STEPS TO TAKE AFTER AN ACCIDENT

If you’re seriously injured, the first thing you should do is seek medical attention. Not only is your health of upmost importance, seeing a healthcare provider ensures that you leave a paper trail of your injuries, which could prove useful if your accident evolves into a lawsuit.

On the other, if you’re not seriously injured, you should still seek medical attention eventually, but stick around and use your smartphone to take videos and photos of the scene and the damaged cars. Talk to all of the parties involved (including witnesses) and write down important information such as names, addresses, license plate numbers, driver’s license numbers, insurance policy numbers, and phone numbers.

Contact the police as well, since you’ll want them to write up a Traffic Collision Report (TCR). TCRs can be a helpful tool for gathering evidentiary information to build and maximize the value of your personal injury claim.

WHO PAYS WHEN AN UBER OR LYFT CRASHES?

Unlike most companies, Lyft and Uber drivers are classified as independent contractors, and not employees. As a result, drivers are expected to have their own car insurance. However, both ridesharing services do manage an insurance policy for their drivers, to pair along with their own. As a passenger, this benefits you. Minimum coverage per accident under both Uber and Lyft insurance policies look like this:

  • Injury liability: $50,000
  • Total liability: $100,000
  • Property damage: $25,000
  • Third-party total liability: $1,000,000
  • Uninsured or underinsured motorist bodily injury coverage: $1,000
